1. Apr. 2023 · Criminal law conforms to the instrumental principle when the existence of its norms helps to prevent or ameliorate moral wrongdoing. Our argument is that the instrumental principle forms part of the internal morality of criminal law, and supplies a justification for criminal laws that depart from the mirror principle.

Since the criminal law is concerned only with acts, it is to be observed that a person's moral status, if it may be so termed, is not the object of criminal sanctions. It is no offence to be a dope addict, a prostitute, a liar, a sadist, or a prodigal, or to belong to any other allegedly morally reprehen- sible group.
