According to the criteria laid down by the OECD, the permanent establishment as a legally dependent part of the company based in the domestic market is defined as a fixed place of business which is used to fully or partly carry out the business operations of a company.
Business Establishment There are different ways to enter the German market. Expan- ding foreign companies normally opt to establish a local sub- sidiary or register a local branch office. Foreign companies often choose the private limited liability company option (Gesellschaft mit beschränkter Haftung – GmbH) for local subsidiary formation.
